The last ditch attempt by the Zee Telefilms to secure the lucrative cricket telecast rights from Board for Control for Cricket in India failed today as the Supreme Court dismissed its appeal challenging a Madras High Court order.

A bench comprising Chief Justice RC Lahoti, Justice N Santosh Hegde and Justice GP Mathur dismissed the petition after hearing lengthy arguments from Zee’s counsel and senior advocate Harish Salve.

“You can move a civil court for seeking damages,” the bench observed while refusing to interfere with the May 2 order of the High Court upholding BCCI’s decision to cancel the tender process for awarding telecast rights for international cricket matches till 2008.

Zee had emerged as the highest bidder for the telecast of the cricket matches for a four year period, but after ESPN-Star Sports approached Bombay High Court challenging the decision of the board to give the contract to Zee ahead of the Australian cricket team’s tour of India, the BCCI had cancelled the entire tender process.
