The Supreme Court verdict on the 1993 blasts described India as one of the worst victims of terrorist acts,and said that the training received in Pakistan materialised in the unfortunate serial blasts in Bombay and that this shows the tolerance and encouragement shown by Pakistan towards terrorism.
The bench of Justices P Sathasivam and B S Chauhan said it was devastating to note that Pakistan,despite being a member of the UN,has infringed the recognised principles under international law,which obligates all states to prevent terrorist attacks emanating from their territory and inflicting injuries to other states. It said it cannot be ignored that a responsible state owes an obligation not only to another state but also to the international community as a whole.
In batches,12 of the convicts were sent to Islamabad,where they were trained by ISI or Pakistan army personnel,as testified by Md Usman Jan Khan,one of the trainees who later turned approver and was pardoned by a magistrate.
The accused8230; were received by ISI operatives who took them out of the airport without observing immigration formalities. Meaning thereby,they had a green channel entry and exit in Pakistan. Another confession reveals that they received training from ISI officials themselves on some occasions, the court said. Confessional statements expose that a large number of accused received training8230; in Pakistan which was organised and methodically carried out by Dawood Ibrahim,Anees Ibrahim,Mohd Dossa and Salim Bismillah Khan.
On fanaticism
Terrorism is a plague for a nation or society that should be eradicated, the bench said. It noted that whenever the perpetrators were motivated by religious fanaticism or had secular goals and beliefs,they turned susceptible to the idea of sacrificing their lives for carrying out the will of God,or Allah or in waging a holy war. 8230;Such terrorist acts should not be allowed to destroy the very basic structure of our Constitution8230; It is important to note here that terrorism is abhorred and condemned by all religions.
On police officers
Unfortunately8230; police officers themselves have taken active part in smuggling and transportation of arms and explosives in Bombay, the court said,upholding the conviction of at least eight police officials under charges of conspiracy and dereliction of duty. They should always remember that when they fail in their duty they eventually fail the society as a whole, it said.
On customs,coast guard
It is shattering to notice that all grades of customs officers,including the Commissioners of Customs,played an active role as members of conspiracy and implemented the plan8230; The court confirmed the conviction of four customs officials.
The court said the blasts had shown deficientperformance of the officials expected to guard the coastline. Only well-strategised coast guards and high morale customs officers can prevent any opportunity for terrorists to attack our country via our maritime boundary.
