
CHANDIGARH, Oct 13: A bench of the Central Administrative Tribunal comprising judicial member Jasbir S. Dhaliwal rejected the claim of Jagdish Chand of Northern Railways, posted as gatekeeper at Gate No. A-8/A, narrow gauge, Pathankot.
The applicant approached the tribunal with the grievance that one Tarsem Lal was posted at Gate No. A-8/A without his being relieved and that he was reverted as gangman. He added that he was promoted as gatekeeper in November, 1990. The applicant contended that his reversion after eight years was unconstitutional and that it was not in public interest.
The respondents submitted that the categories of gangmen, gate keepers, trollymen and chowkidars have a common cadre, combined seniority, identical pay scales and comprise one feeder cadre for further promotions. While working as gangman the applicant was merely posted as gatekeeper, however, his continuation was found risky and he was posted back as gangman in his own cadre and that it did not involve any reversion.
The bench accepted the stand of the railways and rejected the claim of the applicant as being devoid of merits.
