In an affidavit to the Bombay High Court,the Maharashtra Industrial Development Corporation (MIDC) has admitted that it has not been effective in dealing with the problem of encroachment due to limited resources.
The affidavit filed by Ravindra Kshirsagar,executive engineer,states that since MIDC does not have a separate department/force dealing with encroachment it could not effectively deal with it. The affidavit states that 244 hectares of MIDC area in the neighbouring Thane district has been encroached upon.
The affidavit was filed in response to a PIL by Harit Vasai Sanrakshan Samiti against rampant illegal construction in Thane especially in Vasai-Virar belt. Kshirsagars affidavit states that it is largely dependent on law enforcement agencies for giving protection while removing encroachment. However such a protection is not always available,it states.
The MIDCs affidavit further concedes that in some of the encroached areas,removal was unsuccessful due to local opposition and law and order problem. MIDC,however,says that steps are being taken to remove encroachers. It also says that encroachment occurs because MIDC cannot develop entire acquired land at one go.
The court,at earlier hearings,had directed various civic authorities in Thane district to carry out survey of unauthorised constructions in their respective areas. Government earlier sought time till December to complete the survey. However,petitioners lawyer Uday Warunjikar contended that once model code of conduct came into effect for assembly polls there would be no progress.
But government pleader Sudip Nargolkar assured the court that surveying would be over by August 15.
The court has adjourned the hearing till August 20.
