In fight against injustice,skys the limit for us
NEW DELHI: The Supreme Court on Friday asserted that sky is the limit for exercising its extraordinary jurisdiction in the interest of justice.
A bench of Justices J M Panchal,H L Dattu and H L Gokhale made the observation in a judgment restoring the charge under Section 498A harassment of wife by husband or other family members against a police officer A Subash Babu on the complaint of his second wife.
The apex court rejected the Andhra Pradesh High Courts reasoning that since marriage of the accused with another woman during the subsistence of the first marriage was void,the second wife cannot a lodge a complaint under Section 498A.
Article 136 is a special jurisdiction. It is residuary power. It is extraordinary in its amplitude. The limits of Supreme Court when it chases injustice,is the sky itself. Further,the powers under Article 136 can be exercised by the Supreme Court,in favour of a party even suo motu when the court is satisfied that compelling grounds for its exercise exist, Justice J M Panchal observed.
The court further said that in bigamy cases,the magistrate can take cognizance of the offence on the basis of a police report.
Another Mumbai blast victim dead,toll 21
MUMbAI: Another grievously injured victim of Opera House bomb blast succumbed to his head injuries on Friday evening,taking the toll of the July 13 blasts to 21. Shripal Bhojpura 35,who was in coma since he was brought injured to Harkishandas Hospital,had suffered multiple skull fractures and brain injuries and had been in the hospitals critical unit for the last nine days. Bhojpura,who was employed at Opera House,is survived by his wife.
Deemed varsities: No deadline extension
NEW DELHI: The Supreme Court on Friday refused to grant more time to the Centre to complete its probe against 44 deemed universities and asked it to file its recommendations on their derecognition for failing to maintain proper academic standards by August 24. A Bench of Justices Dalveer Bhandari and Deepak Verma turned down the governments plea of 10 more weeks and directed it to file the report by August 24.
Chandraswami withdraws plea
NEW DELHI: Controversial godman Chandraswami on Friday withdrew his petition in the Supreme Court challenging the around Rs 9 crore penalty imposed by the Enforcement Directorate in several FERA violation cases against him. The counsel,appearing for Chandraswami,told a Bench headed by Justice Aftab Alam about his decision to withdraw the matter. Earlier,on June 16,the apex court had turned down the plea of Chandraswami to extend the time and asked him to pay Rs 9 crore.
Dutt allowed to go abroad for shoot
NEW DELHI: The Supreme Court on Friday allowed Bollywood actor Sanjay Dutt,convicted in the 1993 Mumbai serial blast case,to go abroad till January 10 next year. A Bench of Justices P Sathasivam and B S Chauhan asked the actor to surrender his passport within a week after coming back to the country. The apex court passed the orders on a petition filed by the actor seeking the courts permission to go abroad for shooting of a film till June 2012.
4 Naxals surrender in Sonbhadra in UP
LUCKNOW: Four Naxals belonging to Munna Vishwakarma-led Peoples Guerrilla Squad surrendered before the Sonbhadra SP on Friday. The UP government has announced a reward of Rs 2 lakh on Vishwakarmas head. Special DGP Law amp; Order Brij Lal said the Naxals identified as Guddu Singh and Ram Dular of Rohtas in Bihar,Surendra of Palamu in Jharkhand and Sunil Ravidas of Chandauli in UP also handed over three SLRs,200 live cartridges and a hand-grenade to the police.
