Tata Housing Company and its builder have denied the Chandigarh Administrations claim that the land where the Tata Camelot housing project is proposed is a controlled area. It also said that the UT has allowed several developments to take place on controlled areas. Chandigarh itself has carried out/ permitted varied development works in the area including controlled area.
The builder asked why varied development allowed by the UT in the periphery like Rajiv Gandhi Information Technology Park,Mansa Devi complex,Zirakpur,Kharar,Mullanpur had not been objected to by the petitioner or the UT.
Tata Housing Development Company further submitted that the Camelot project falls in the residential zone of the master plan of Nayagaon. Terming the affidavit filed by the UT misdirected,misconceived,irrelevant,mischievous,the Tatas said that the challenge to the project is premature and all the necessary clearances have been obtained except wildlife and environment.
Responding to the UTs stand that the Camelot project will demolish the heritage of the City Beautiful,the Tatas have submitted that the law cannot be challenged on the ground of non-legal and general grounds such as alleged insensitivity. The Edict of Chandigarh can only apply within the boundaries of Chandigarh and not beyond. On the allegations of non-compliance of recommendations of the Coordination Committee,the Tatas said,Punjab is not bound to accept any recommendations made by Chandigarh for formulation of the master plan.
The Periphery Control Act does not bar construction in controlled areas and only imposes a restriction on construction activity by seeking permission from the concerned authorities, the Tata firm and its builder submitted.
Hash Builders have submitted that Camelot is coming up in the North-East and not in the North of Capitol Complex,Chandigarh.
