UT allowed developments in controlled area: Tata Housing

Detailed replies by the Tatas and Hash Builders were filed in the Punjab and Haryana High Court today in response to a PIL filed by Advocate Aalok Jagga,challenging the Tata Camelot project. The Tata firm has categorically submitted that the Periphery Control Act does not apply to the land where the project is to come up. On the last date of hearing,the UT Administration had stated that the land for the project is a controlled area.

Tata Housing Development Company further submitted that the Camelot project “falls in the residential zone of the master plan of Nayagaon”. Terming the affidavit filed by the UT “misdirected,misconceived,irrelevant,mischievous”,the Tatas said that the challenge to the project is “premature” and all the necessary clearances have been obtained except wildlife and environment.

Responding to the UT’s stand that the Camelot project will demolish the heritage of the City Beautiful,the Tatas have submitted that the “law cannot be challenged on the ground of non-legal and general grounds such as alleged insensitivity. The Edict of Chandigarh can only apply within the boundaries of Chandigarh and not beyond”. On the allegations of non-compliance of recommendations of the Coordination Committee,the Tatas said,“Punjab is not bound to accept any recommendations made by Chandigarh for formulation of the master plan”.

“The Periphery Control Act does not bar construction in controlled areas and only imposes a restriction on construction activity by seeking permission from the concerned authorities,” the Tata firm and its builder submitted.

Hash Builders have submitted that Camelot is coming up “in the North-East and not in the North of Capitol Complex,Chandigarh”.
