The Lucknow Police on Saturday told a local court that Bahujan Samaj Party MP Rakesh Kumar Pandey,against whom a non-bailable warrant has been issued in a case of murder and kidnapping,is untraceable. However,Additional Session Judge R V S Gautam directed the police to execute the NBW and posted the matter for hearing on August 16.
Pandey,who is a member of the Lok Sabha from Ambedkar Nagar,has been given chargesheet in the case which dates back to 1998. He has not appeared in the court since last December,which has delayed framing of charges and further proceedings.
According to case details,Kunal Rastogi,a businessmans son,was kidnapped from Lucknows Hazratganj area on May 26,1998. The kidnappers intercepted the car in which Kunal and his father Kamal Krishna Rastogi were travelling,dragged Kunal out at gunpoint,fired at his father and sped away. Kamal Krishna,who was seriously injured,was rushed to hospital by passersby where he succumbed to injuries.
After about a fortnight,Kunal returned his home. During investigation,the police found that the crime was committed by gangster Shri Prakash Shukla who was later killed in an encounter in Ghaziabad. In 1998,the police filed the chargesheet against 13 persons including Pandey. According to the chargesheet,Pandey had given shelter to the kidnappers and kept Kunal at his residence.
In August 2002,the court had discharged five of the accused but rejected Pandeys discharge application. According to the MPs lawyer Pradeep Srivastava,Pandey then approached the high court where the matter is still pending.
