CHANDIGARH, April 9: Allowing the appeal of Data Management Sevices, Chandigarh, against the order of District Forum 8211; II, UT Consumer Disputes Redressal Commission bench, comprising president J. B. Garg and members P. K. Vasudeva reduced the amount of compensation earlier awarded to the complainant to almost half.

The complaint in the Forum was instituted by 16 Punjab, Patiala and it had been alleged that the said firm was not returning the defective computer printer sent for repairs. Following this, the Forum had ordered that the respondent would pay Rs 12,500 to the complainant.

The complainant had purchased the computer printer from the said firm for Rs 15,250. Later, some defect arose in the printer and it was given to the firm for repairs. An amount of Rs 5,000 was given for the same. It was alleged that despite several visits to the said firm, the printer was not returned to them. Later, the opposite party admitted that the printer was untraceable and they also offered to pay Rs 3,000, but the complainant declined to accept the same.

The commission bench, however, decreased the amount of compensation awarded from Rs 12,500 to Rs 7,625, stating that the printer had been used by the complainant. The bench further directed the firm to pay an interest at the rate of 18 per cent per annum in case the amount of compensation was not paid within two months.
