Putting aside their political differences,over 50 members of the Rajya Sabha belonging to the BJP,Left and other parties are said to have signed a letter seeking to initiate proceedings for the impeachment of Karnataka High Court Chief Justice P D Dinakaran. No one from the Congress is part of this move. We are in the process of collecting signatures of MPs and we will,hopefully,submit the letter to Rajya Sabha Chairman Hamid Ansari sometime next week, CPM leader Brinda Karat told The Indian Express this evening. Sources said the letter these MPs are signing echoes allegations of misdemeanour and corruption against the judge that find mention in an impeachment motion drafted by the Campaign for Judicial Accountability and Reform and its convener Prashant Bhushan earlier this week. Sources in the BJP confirmed that several party members have signed this letter which could be handed over to Ansari as early as Monday. For Justice Dinakaran,this spells double-trouble. It not only implies another hurdle in the way of his elevation to the Supreme Court but also threatens to cast a shadow over his continuation as Chief Justice of the Karnataka High Court. In a similar exercise,the Right and Left members of the Rajya Sabha had come together to seek the impeachment of Justice Soumitra Sen of the Calcutta High Court. An impeachment motion is a protracted process undertaken only once in the past,in the case of Justice V Ramaswami of the Supreme Court. That,too,fell through when members of the ruling Congress voted to defeat it. The Judges (Inquiry) Act,1968,stipulates that a motion for removal of a judge involving allegations of misbehaviour or incapacity may be admitted if notice is given by at least 100 members of the Lok Sabha or 50 members of Rajya Sabha. Then it can be referred to a committee for investigation.
