CMO murder: Court sends back chargesheet

Chief Judicial Magistrate Rajesh Upadhyay on Thursday refused to take cognisance of the chargesheet filed in connection with the murder of Chief Medical Officer Dr BP Singh.

In a setback to the police,Chief Judicial Magistrate Rajesh Upadhyay on Thursday refused to take cognisance of the chargesheet filed in connection with the murder of Chief Medical Officer Dr BP Singh,saying it was based on incomplete investigation.

“The haste of the investigating officer is beyond comprehension,” the court said and asked the police to file the chargesheet after completing investigation.

On Wednesday,investigating officer Abhimanyu Dwivedi had filed a chargesheet against three persons,Anand Prakash Tiwari,Vinod Sharma and R K Verma,for the murder of Singh who was shot dead while he taking a morning walk near his residence in Gomti Nagar on April 2.

All three were arrested on June 17 and two pistols,two vehicles and cellphones were seized from them.

After the proceedings began,the CJM observed that on the last page of the chargesheet,the investigating officer had stated that evidence was being collected against the accused.

He asked the prosecution officer why the chargesheet had been filed without completing the case diary and investigation. The prosecution officer replied that only the investigating officer can answer the question.

The IO,who was present,said some documents were still to be verified. The court found his explanation “not satisfactory” and returned the chargesheet.

Pointing out that the chargesheet can be filed within 90 days from the arrest of the accused and this limit was not yet over,the court said,”The haste of the investigating officer is beyond comprehension.”

The chargesheet says Tiwari and Sharma had carried out the murder of Singh at the instance of Deputy CMO Y S Sachan,who was found dead recently.

It alleged that Sachan decided to get Singh eliminated when he demanded a share in the kickback in drug supplies and threatened initiate an inquiry if he did not pay.
