Nokia to replace defective mobile set

The District Consumer Forum has directed mobile manufacturer Nokia to replace a mobile set with a new one after it was found to be defective. In case, the mobile cannot be replaced, the forum asked the company to refund an amount of Rs 21,980.

The complainant, Mandep Kumar, a resident of Manimajra, purchased a Nokia N-73 M mobile handset from Sector 22 for Rs 21,980 in 2007.

He alleged that the mobile set started giving problem within two days of its purchase. He approached the dealer for rectification, who returned the same after 10 days with an assurance that the set would function properly.

The complainant alleged that it worked only for some hours only to result in the same problem again.

He then visited the Nokia Care Centre with a request to replace the handset as it was in the warranty period. The handset was again kept by the centre and after about a month, the same was given back to him.

The same problem recurred and he was then assured that the set would be replaced.

However, they failed to refund him the money or replace the handset.

The counsel for Nokia failed to file a reply.

The forum found that the mobile set was defective, which was proved by job sheets. The forum said the defect occurred well within the warranty period, therefore, the whole amount should be refunded to the complainant.
