Sohrabuddin Sheikh encounter case: Lone accused confined to Mumbai gets relief from SC, can now enter Gujarat

Earlier in 2012, Chaubey along with other co-accused, including retired IPS officer D G Vanzara and Rajkumar Pandian, were shifted to Mumbai’s Taloja jail from Ahmedabad after the trial of the case was shifted there by Supreme Court.

The lone accused in the Sohrabuddin Sheikh encounter case, who had been confined to Mumbai, got relief from the Supreme Court after it modified the bail condition granting him permission to leave the city.

Balkrishna Chaubey, who was promoted as Deputy Superintendent of Police (DySP) last year, had moved the apex court for bail modification which was allowed by Supreme Court Friday. Chaubey, who was living in Mumbai since 2014 after he was released on bail, can now enter Gujarat.

Pandian and Chaubey were the first accused who were granted bail by the apex court in 2014 with similar condition not to leave the periphery of Mumbai. Pandian’s bail condition was modified earlier this year. Pandian is still posted at Gujarat Industrial Development Corporation (GIDC) as a liasoning officer, while Chaubey is posted as liasoning officer at circuit house, Juhu in Mumbai.

According to sources, both have sought their transfers back to Gujarat. Sources said that Pandian has written a letter to the Home Department seeking transfer back to Gujarat police citing his bail modification order. Senior officials in the department said that a decision will be taken soon.

Chaubey and Pandian are among the key accused arrested by CID (crime) back in 2007 in Sohrabuddin Sheikh fake encounter case. After the CBI took over the investigation IPS officer Abhay Chudasama, BJP president Amit Shah among others were also arrested. The two have been discharged from the case by the trial court after CBI failed to prove their case against them.

Sheikh and wife Kauser Bi were allegedly abducted by Gujarat ATS from Hyderabad and killed in a “fake encounter” near Gandhinagar in November 2005.
