CHANDIGARH, Dec 1: Continuing with the arguments on the application seeking stay on Justice Kuldip Singh8217;s functioning as the World Sikh Council president, plaintiff Baldev Singh Brar today claimed that the retired Supreme Court Judge could not be appointed as the Council head.

Arguing before City Civil Judge Senior Division B.C. Gupta, Brar stated that Justice Kuldip Singh was appointed by patron Bhai Ranjit Singh, who had no authority to make nominations.

Claiming the absence of the patron8217;s post in the registered constitution of the WSC, Brar also refuted the defendant8217;s contention regarding Bhai Ranjit Singh being appointed quot;after the constitution was revised in accordance with the bylawsquot;.

He added that the defendants had failed to place any document on the file to establish Justice Kuldip Singh8217;s appointment.

Terming the revised constitution as quot;illegalquot;, Brar also claimed it to be self contradictory. He stated that according to modified constitution, the SGPC president was also the chairman-cum-president. The arguments on the application will continue tomorrow.

Earlier, Justice Kuldip Singh8217;s counsel, in his reply submitted before the court, had claimed that the plaintiffs had no locus standi to challenge the functioning of the World Sikh Council. He had elaborated that an ordinary Sikh or an advocate had no legal right to challenge the Council8217;s functioning as it was registered under the Societies Registration Act, 1860.
