In the Flag Code, flying of the National Flag by members of general public and private bodies/organisations after sunset has neither been categorised under 8216;misuse8217; nor under 8216;incorrect display8217;.

The Ministry of Home Affairs had come out with clarifications on June 25, 2002, which make it amply clear that lowering of flag at sunset is not mandatory in the case of private bodies/general public: 8220;As regards

the specific query of para 2.2 xi, while it is incumbent on the official/Government bodies/institutions to fly the national flag from sunrise to sunset only, for the members of general public,

it has been provided that the flag may be flown by them, as far as possible, from sunrise to sunset. In other words, the lowering of flag at sunset is not mandatory in the case of private bodies/general public.8221;

The police came to the premises of Jindal Power Limited at Raigarh at 7.15 pm on October 19, and without having knowledge of or understanding the provisions of Flag Code, booked a case against the company.

We would request you to kindly publish the clarification so that members of general public become aware of the provisions of the Flag Code as far as flying of the National Flag after sunset is concerned. They can have the National Flag up even after the sunset without infringing the law of the land or violating provisions of Flag Code.
