Taking cognizance of a complaint alleging that the Lokayukta was appointed in violation of procedures,Governor Ramnaresh Yadav has asked the Madhya Pradesh government to take necessary action in this regard.
The Governors missive,dated December 27,has come in response to an RTI application seeking to know if the complaint filed in July had been acted upon.
Retired Supreme Court Justice P P Naolekar was made MP Lokayukta on June 26,2009 for a period of six years. His image has already taken a serious beating with the Opposition accusing him of protecting the members of the ruling BJP.
RTI activist Ajay Dubey had alleged in the complaint that the government did not follow proper administrative procedure while appointing Naolekar; only one name was considered instead of forming a panel of eligible persons/judges,and the chief minister forwarded the name to Cabinet without discussion; and then Leader of Opposition Jamuna Devis consent was taken by fax when she was ill without apprising her of facts,which is a procedural violation.
Dubey said that his July complaint was not accompanied by written evidence,so he filed another application on October 24 with necessary documents.
On December 12,he filed another RTI application to know what action had been taken on his complaints,and received a reply on January 4. The Raj Bhavan has marked copies of the reply to the principal secretary (GAD) and the chief secretary.
Dubey said it was ironical that the Governor has asked the chief secretary to carry out a probe because the Lokayukta was hearing a complaint against him.
