Review petition filed against HC order on PF assessment

Gwalior: A revision petition has been filed by two private companies in the Gwalior bench of the Madhya Pradesh High Court to review its earlier order directing them to calculate conveyance,house rent and special allowance in the basic wage for calculating provident fund of employees.

Montage Enterprises Private Limited and U-Flex filed the petition before the division bench of justices S K Gangele and Brij Kishore Dube,asking for its review of the courts judgement of March 24,2011 on the issue.

The same bench had asked them to carry out the exercise for the benefit of their employees. The story was first reported by The Indian Express on July 19. The bench in its judgement has laid down a principle for treatment of certain allowances like conveyance/ transport and special allowance among others as the component of basic wages for the purpose of provident fund liabilities if the same are being paid uniformly,necessarily and ordinarily to all employees.
