
CHANDIGARH, Oct 13: As notices could not be served on SGPC president Gurcharan Singh Tohra, Justice Ranjit Singh Narula, besides Dr H K Manmohan Singh, the hearing on the application seeking restrain on Justice Kuldip Singh8217;s functioning as the World Sikh Council8217;s president was adjourned by UT Civil Judge Junior Division Tejwinder Singh today.
The other application moved by the plaintiffs 8212; former MLA Talib Singh Sandhu and Baldev Singh Brar 8212; seeking directions to Justice Kuldip Singh for producing the quot;alleged appointment letterquot;, besides the statement of accounts relating to the funds of the council, will, meanwhile, come up for arguments tomorrow.
The third application for initiating contempt of court proceedings against defendant, Brigadier Gurdip Singh and his counsel, for allegedly quot;making a false statementquot; will be taken up by UT District and Sessions Judge B S Bedi on November 14.
Earlier during the day, the World Sikh Council case was transferred to the court of Civil Judge Senior Division B C Gupta by the District Judge. The matter was, however, taken up by Civil Judge Tejwinder Singh as Civil Judge B C Gupta was on a two-day leave.
On behalf of the WSC, Brigadier Gurdip Singh, had yesterday moved an application for transferring the suit to UT Chief Judicial Magistrate Sant Parkash8217;s court.
He had stated that the CJM was aware of the entire background related to the WSC controversy as he had been dealing with a similar suit filed by Shamsher Singh Maloya. The plea had, however, been opposed by the plaintiffs.
Today, seeking stay on Justice Kuldip Singh8217;s functioning as the president, plaintiff Baldev Singh Brar, arguing in person, asked for immediate disposal of the application. He stated that Justice Kuldip Singh was going abroad on October 15 in his capacity as the president. He, however, refused to give up the interim injunction claim against Tohra and the other two defendants when informed regarding their not being served the notices. Subsequently the hearing on the application was adjourned till the notices were served.
Regarding the application seeking documents from Justice Kuldip Singh, his counsel stated that neither the notice on the plea, nor the copy was handed over to him. Following his plea, the arguments on the application were adjourned till tomorrow.
