The Supreme Court will give verdict on constitutionality of Bihar Assembly dissolution tomorrow. A five-judge Constitution bench of the court presided by Chief Justice of India YK Sabharwal will give detailed reasons why the dissolution was unconstitutional.

The bench, in an interim order, had by majority opined that the dissolution was unconstitutional, but polls were unavoidable due to changed circumstances. It had said that reasoned judgment would be delivered.

The judgment will set guidelines for similar situations and give directions on do’s and don’t’s on dissolution of an Assembly.

Several petitions by a group of legislators of the dissolved Assembly and a Public Interest Litigation by SC advocate Viplav Sharma were submitted. The 2005 elections threw up a hung Assembly.

The governor recommended dissolution amid allegations that he prevented the National Democratic Alliance, which was on verge of cobbling up

a majority with breakaway group of Loktantrik Janata Party of Ram Vilas Paswan and few independents, from forming the government.
