Gawli gets back security cover

Underworld don Arun Gawli, whose police protection had been withdrawn following an administrative order of the Bombay High Court, has been given back security by the court.

Last year, Gawli had filed a petition seeking police protection from rival gangs. His petition was admitted and he was given limited protection while attending various dates in different courts of law, where he is being tried. Since Gawli was detained in jail at that time, there was no question of availing of the protection. But when he came out this September, he sought security for attending a hearing at Sessions Court. But he was informed the order for protection had been vacated and so police were not bound to provide him protection.

Gawli8217;s counsel P M Pradhan then inquired with the court registrar about the new order. He was told that on January 9, 1998, the CJ had passed an administrative order. The CJ had ruled that since Gawli8217;s petition pertained to the subject of fake encounters, itdeals with a common subject raised by three other petitions. But Pradhan told the registrar Gawli8217;s petition was not related with the question of fake encounters. When the mistake was pointed out to the CJ, he referred the matter before another division bench of Justice A A Desai and Vishnu Sahai. They opined that the wrong administrative order can be corrected. And therefore, the HC recalled the January 9 order.
