
Barely a week after a two-member Division Bench of the Madras High Court gave a split verdict, the ruling DMK on Wednesday suddenly announced its decision to face fresh polls to 99 wards in the 155-member Chennai Corporation Council.
Several parties had petitioned the court for a repoll, alleging unprecedented violence in the polls to the Chennai Corporation Council held last October. The DMK8217;s own allies had accused it of having indulged in violence, rigging and booth capturing.
Last week, the Division Bench gave a split verdict. One judge ordered re-poll in 99 wards while the other dismissed all petitions against the elections, ruling that there was a constitutional bar against entertaining such pleas after the poll process had begun. While Justice Ibrahim Kalifulla had described the violent incidents as 8220;an extraordinary situation warranting an extraordinary remedy,8221; Justice S J Mukhopadhyaya did not go into the merits of the case, dismissing all the writ petitions saying Article 243ZG of the Constitution barred public interest litigation in poll matters.
