
CHANDIGARH, Nov 19: The anticipatory bail plea moved by a Haryana police constable Balwinder Singh, accused of raping his wife by concealing his first marriage, has been dismissed by UT Additional District and Sessions Judge S. S. Lamba.
He was booked by the Chandigarh Police for cheating, rape, marrying again during the lifetime of a wife and subjecting a married women to cruelty, besides criminal conspiracy on his wife’s complaint.
According to the prosecution, the second wife was not told about his first marriage and came to know about it only after about two-and-a-half years. The judge, while pronouncing the orders in the open court, observed: "prima facie offence under Section 376 of the Indian Penal Code is made out. In this view of the matter, thus, I do not consider it a fit case to grant concession of anticipatory bail".
