CHANDIGARH, March 11: UT District Consumer Disputes Redressal Forum has directed Classy Mobikes, Chandigarh, and Escorts Yamaha Motors, Faridabad, to replace the defective vehicle of the complainant with a new one and also pay him Rs 2,100 as costs.

Complainant Anil Kumar earlier stated that he purchased a Yamaha RXG motorcycle on April 7, 1997, from Classy Mobike. The vehicle, which had six-month warranty, started giving trouble after running 1,800 km.

The matter was reported to the dealer who got the full piston kit changed. The problem recurred and the piston kit had to be changed thrice in a short span of five months, entailing a cost of Rs 4,000.

In its reply, the opposite party stated that the piston was replaced as a gesture of goodwill and that the consumer was fully satisfied with the service.

It was added that spare parts were replaced without any charge.The Forum bench comprising president R.P. Bajaj and members H.S. Walia and Kamlesh Gupta, after perusing the records, observed that the vehicle suffered from a serious manufacturing flaw and it was in order to remove this flaw that the piston kit was changed thrice.

The explanation of the opposite party that the kit was changed as a gesture of goodwill was hard to be believed, the bench held.

Further recording that the opposite party had not denied replacement of the kit thrice in a period of five months, the Forum ordered the respondents to replace the complainant8217;s vehicle with a new one and also pay him Rs 2,100 as costs.
