
AHMEDABAD, MAY 7: The Gandhinagar Additional Session judge B S Parikh has granted conditional bail of Daxa Shukla and Kunal Shukla, who have been named in the Ruchi Chavda kidnap case.
In the judgment on Wednesday, the judge granted bail against the deposit of Rs 10,000 to both. Parikh further directed Daxa to not leave Gandhinagar and to also deposit her passport in the court. Similarly, Kunal will only be allowed to go to Ahmedabad for studies. The two have been directed to cooperate in the investigations whenever required.
The court observed that the investigating agency had failed to produce any clue in court, proving Daxa’s involvement in the crime. He further said that Daxa, who was arrested on April 9, was in judicial custody for 25 days including two remands, one to the police and another to the CBI, but the police has failed to prove her involvement.
Moreover, the court observed that the confession of a person cannot be used in the capacity of a witness for non-granting of bail. The court observed that the statements cannot be produced in the court for trail. Besides, the court also observed that Ruchi has, in her short statement to the Kagdapith police, stated that Nilesh had taken her, but she has not mentioned the name of Daxa Shukla in her statement. The court said that the investigating agency had also failed to produce evidence that Daxa had contacted Nilesh during his stay in Mumbai or Ambala, as per the statement of Nilesh.
