DDA clears proposal for conversion of properties from leasehold to freehold

The lease-administrating agencies of DDA will process the conversion applications subject to completion of all other formalities.

The Delhi Development Authority (DDA) has approved a proposal for conversion of properties from leasehold to freehold on the basis of registered Agreement to Sell and General Power of Attorney (GPA), which had been suspended in the wake of a Supreme Court judgment on October 11, 2011. The move is expected to provide relief to thousands of people.

“The competent authority in DDA, after taking the opinion of the Solicitor-General of India, has decided to allow such conversion subject to production of documents authenticating that the transaction is genuine. The genuineness will be verified at the time of processing of conversion application,” an official said.

The person seeking conversion on the basis of a GPA will have to produce several documents like Agreement to Sell registered with Sub-Registrar of Delhi. “The registered Agreement to Sell should contain the stipulation that the entire sale consideration has been received by the seller and the physical possession of the property has been delivered to the purchaser. Verification of the physical possession of the applicant, who has applied for conversion of leasehold tenure into freehold, will be done by way of electricity bills, water bills, telephone bills etc.,” the official said.

The lease-administrating agencies of DDA will process the conversion applications subject to completion of all other formalities.
