SC: House should pass law on road blockade

The Supreme Court Monday said it was for the Parliament to pass a law and not for a court to pass directives.

The Supreme Court Monday said it was for the Parliament to pass a law and not for a court to pass directives against agitations involving road blockades. We cannot monitor these type of cases. We cannot say where would these agitations be permitted and in what form. It is for the government,state as well as the Centre,to look into these issues, said a Bench led by Justice H L Dattu.

It is not for the Supreme Court to issue directions or guidelines. Courts cannot interfere into such matters. You should go to the appropriate authority. You can also file criminal cases whenever situations arise but certainly,we cannot monitor blockades and other forms of protests, said the Bench while disposing of a PIL by O P Bhandari,a Gangtok-based lawyer. He had moved the court against repeated blocking of NH 31-A,connecting Siliguri in West Bengal with Gangtok in Sikkim,during the agitation for a separate state of Gorkhaland.
