HC issues notice to Centre,Air India

The petition asked for setting aside the May 9 ex-parte order of the single-judge,who had subsequently issued a contempt order against the striking pilots for not resuming work.

The Delhi High Court today issued notices to the Central government and Air India on a petition by the striking pilots,questioning the authority of a court in Delhi to entertain the plea against their ongoing agitation.

A vacation bench sought replies from the parties by July 13 after the Indian Pilots Guild IPG,representing the pilots of erstwhile Air India,moved an application,seeking to vacate a stay on the courts order that had restrained them from continuing with their strike and report sick.

The petition asked for setting aside the May 9 ex-parte order of the single-judge,who had subsequently issued a contempt order against the striking pilots for not resuming work.

The Indian Pilots Guild,in its plea,sought to set aside,vacate and discharge the single-judge order,contending the Delhi High Court lacked jurisdiction as its office was in Mumbai.

This court lacks jurisdiction to entertain this suit also in view that the dispute involved is squarely within the definition of industrial dispute under the provision of the Industrial Disputes Act, said the petition.
