Sohrabuddin ‘encounter’ case: Prosecution says it’s a conspiracy, defence refuses it outright

The framing of charges in the Sohrabuddin Sheikh fake encounter case moved a step further, with both prosecution and the defence making their opening statements before the Ahmedabad City District and Sessions Court.

Thirteen policemen including suspended IPS officer D G Vanzara and Rajasthan Cadre IPS officer Dinesh M N are charged with the murder of Sohrabudin in the guise of a fake encounter in Ahmedabad in November 26, 2005.

Appearing before the court, special public prosecutor V P Atre contended that there was enough evidence and record to establish that there was a conspiracy planned by the accused that ultimately led to Sohrabuddin’s death. The special public prosecutor said that bringing Sohrabuddin from Hyderabad to eliminate him in a fake encounter was a part of the conspiracy.

In their opening statements, the defence lawyers refused to accept the charge of murder foisted upon the policemen. They also objected to charging the accused for the murder of Sohrabuddin’s wife Kauserbi.

Kauserbi was allegedly killed and her body disposed between November 28 and 29. The defence lawyers pleaded before the court that charging the accused policemen with the murder of Kauserbi was premature and there was no direct evidence to bolster the charge.

They further said that accepting the charge of murder will go against the court’s recent order, which has asked the investigating agency to further investigate certain aspects relating to Kauserbi’s death.

The case is next slated for hearing on October 3, when the charges are likely to be framed.
