Mumbai, Aug 24: Former Mayor Nand Kumar Satam filed his nomination papers for the North-Central parliamentary constituency as Shiv Sena8217;s alternate candidate for Manohar Joshi on Monday.

8220;This is not a revolt against the party. I am an alternate nominee for Joshi. If his nomination papers are rejected for technical reasons, only then will I be the official candidate of the Shiv Sena. I filed the papers on the directive of sena supremo Bal Thackeray in consultation with Joshi,8221; Satam told The Indian Express.

Apart from possible technical glitches, Joshi8217;s candidature is under cloud in view of the strictures of the Bombay High Court in the case involving his son-in-law Girish Vyas.

Disposing of a public interest litigation, a division bench of the High Court comprising Justices B N Srikrishna and S S Parkar had held that the former Chief Minister had misused his official position to benefit his Vyas. Under the representation of People Act and also as per the revise guidelines issued by theElection Commission of India to all the returning officer, misuse of power amounts to corruption and as such the nomination papers of such candidates, against whom specific strictures have been passed by the judicial authorities, are to be scrutinised carefully.

8220;Whether to accept the nomination papers of Manohar Joshi or not will be decided by the Returning Officer. If decides to reject them on the basis of the observations of the high court, then Joshi will have to move the high court again,8221; according to a senior government official.

In fact, in view of the court strictures, the Sena was considering to field Satam from Mumbai North Central. However, when Joshi convinced Thackeray that the court verdict will not come in the way of his nomination, the Sena chief cleared his candidature.

According to a senior Shiv Sena leader, one of the independents or a Congress functionary may take objection to the candidature of Joshi on the ground that the high court has passed strictures against the former ChiefMinister.
