HC disposes plea against Gholap
The Bombay High Court today disposed of the petition seeking action against former Social Welfare Minister Babanrao Gholap, one of the accused in the Awami Bank fraud case. It was stated that since investigations have been completed and chargesheet filed, 8220;no useful purpose will be served by keeping the petition pending.8221;
Petitioner Milind Yavatkar had alleged that despite ample evidence to implicate Gholap, police are not taking action due to political pressure. It was prayed that like the Supreme Court in the Hawala case, this court should direct the investigations to be done under its supervision, without interference from the state government. Moreover, the state government should be directed not to transfer the officials investigating the scam.
Additional public prosecutor Rajiv Patil informed the court that the Awami Bank chargesheet was filed. However, petitioner8217;s counsel P Jananrdanan read out certain portions from the earlier court order. He said theorders were not yet implemented. He said the court had perused investigation papers and specifically noted that Gholap is the alleged recipient of Rs 40 lakh. The court had expressed the hope that the investigation officer will probe this fact fearlessly. However, Janardanan argued, the chargesheet does not address this fact.
Yavatkar8217;s petition dealt with alleged wrongdoings and corrupt practices adopted by Gholap. But he has approached the Special Court as well, which in turn has directed the Anti-Corruption Bureau to file an investigation report by October 21. In view of this fact too, the petition was disposed off by the high court.
