BJP chief M. Venkaiah Naidu today suggested that the Centre could amend POTA to make it mandatory for the states to accept the recommendations of the panel reviewing the misuse of the law.
Naidu, during an informal chat with reporters at the party8217;s state headquarters here, said the BJP held the view that review panel8217;s recommendations was binding on all states. He wanted the Centre to urge the panel to expedite its review and submit the report at the earliest.
Asserting that neither Union Minister of State for Non-Conventional Energy Sources M. Kannappan nor MDMK general secretary Vaiko attracted the POTA provisions, he said it would be wiser on the part of Union Ministers not to make statements that would create unnecessary controversies and embarrass the NDA Government.
Asked about DMK8217;s demand that the Centre should not allow the state government to arrest Kannappan under POTA, Naidu said Prime Minister A.B. Vajpayee would take a decision on Tamil Nadu Chief Minister Jayalalithaa8217;s letter soon. At the same time, he maintained that POTA was necessary in the larger interest of the country and there was no question of repealing it.
Though Naidu commended the state government for its resolve to curb militancy and terrorism, he said the government should take care not to use the Act against political opponents.
He said the Centre was willing to help all state governments in fighting Naxalites and terrorists. But the Centre could not fully take up the responsibility as law and order was a state subject.
