During the legal proceedings on January 20, KVN Productions' lawyer revealed that streaming platform Amazon Prime Video warned the makers of legal action if they did not get a clarity on release date. The lawyer shared that they got this information from Amazon on December 31, 2025.

According to the producers, Amazon warned them on December 31 that it could sue if a clear release date was not communicated, as the film was originally slated for a January 9, 2026 theatrical release. The delay occurred after the CBFC referred the film to a revising committee following a complaint, creating last-minute confusion. The issue was highlighted during court proceedings, where the High Court has since reserved its order, while no formal lawsuit has been filed by Amazon so far.

The counsel also argued there was no time to file a counter before the matter came up on January 7 before a single judge, and questioned why the makers, who claimed a Rs 500 crore investment, announced a release date without first securing CBFC certification.

As per the latest update on the case, Madras High Court, however, observed that financial investment or release plans could not be grounds for seeking relief. The division bench also noted that the single judge, who had earlier directed the Central Board of Film Certification (CBFC) to grant a U/A certificate to Jana Nayagan, had "failed to examine" the case in depth.

During a hearing at the Madras High Court on Tuesday, senior advocate Satish Parasaran, appearing for KVN Productions, the makers of Vijay’s Jana Nayagan, referred to Dhurandhar 2 after the court questioned the production house for announcing the film’s release date before obtaining a censor certificate. Parasaran argued that it is common practice for producers to declare release dates ahead of certification, citing Dhurandhar 2, which is already slated for release on March 19. "In 22 countries, we have received approval. It's not a practice to wait for certificate to announce release date. If you see Bollywood, they have already announced Dhurandhar 2," he said.

Mentioning that a member of the board can file a grievance at a later point after watching a movie, ASG Sundaresan said that there was also a complaint that the Armed Forces were not shown properly in the film. Pointing out that certain protocols must be followed during the depiction of the Armed Forces, he stated that an exact analysis of this might not be possible for the committee alone and would therefore require the assistance of an expert. "Whether the complaint is proper is to be decided by the chairperson," he stated.
Stating that the movie received certification in 22 countries, the advocate for Team Jana Nayagan pointed out that the makers of Durandhar have already announced a sequel to the movie.
Pointing out that all dates and records he presented are from the CBFC's website, senior advocate Satish Parasaran emphasised that the member who raised an objection later was required to provide his opinion after viewing the movie. "Even his subsequent opinion, it has been taken care of already through incisions," he added. When the ASG mentioned that the decision to send the movie to a revising committee was made on December 29 and that a communication regarding this was sent to the producer on January 5 via email, followed by its upload on the e-cinepraman website on January 6, Parasaran clarified that this was merely a communication and "not the order."
Parasaran has informed the High Court that on December 31, 2025, streaming giant Amazon notified the movie's producers that they would pursue legal action if there was no clarity regarding the release date.
Pointing out that the complaint has sought the deletion of those scenes which have already been excised, senior advocate Satish Parasaran, appearing for the movie's makers, claimed that the CBFC now wants Team Jana Nayagan to reintroduce those already-deleted portions, submit the movie as it was before, and then expunge the same scenes again. He called the entire step an "empty exercise."
When the court asked the ASG to show it the decision by the chairman, the former maintained that that was not among the submissions. He noted that it will be uploaded to the e-cinepraman website and that a copy of it was given to the single judge. "The communication is from CBFC chairperson Prasoon Joshi to the regional officer Balamurugan," he said. Hearing this, the CJ asked, "Where is this letter? The matter has travelled from the writ court to the appeal court, but no one has seen this document."
When senior advocate Satish Parasaran pointed out that even the ASG would not contest that the case had to be heard that day itself, the CJ maintained that "it had to be heard because you created an urgency." The lawyer further claimed that the members of the examining committee could never become the complainant as per the rules.

He also pointed out that the certificate is to be issued within two days of communication as per the rules.
Pointing out that the board can send a movie to a revising committee even after tentative communication, the ASG said that the decision-making process is complete only when the certificate is granted. Even after the issuance of a certificate, the ASG said, "if there is any difference in the movie that is being shown or any other irregularity, it can be revoked." He has concluded his arguments.
During the proceedings, the court asked the ASG whether there was any provision mandating that the revising committee decide within a stipulated time frame. In response, the ASG said it must be done within 20 days. "So, if there was no case, the revising committee would have been formed on January 6, and by January 26, it would have been done," the CJ asked, to which the ASG replied, "If nothing came in between, it would have been done by January 26."
As he continued his arguments, ASG Sundaresan explained to the High Court the procedure for sending a movie to the revising committee. He further maintained that a film can be sent to a second revising committee if needed.

Before ASG concluded his arguments, he said there are primarily two points they want to raise: one, they were not given time to file counter. Second, the communication dated 6/1 was not challenged.
The High Court has said that it will hear the producers' arguments post lunch. Mentioning that the Supreme Court has asked the HC to try to complete the case today itself, the CJ stated that the bench will hear all arguments and render a decision. The court has adjourned for lunch.
Mentioning that the communication regarding sending the movie to a revising committee was uploaded on the e-cinepraman website, the ASG informed the High Court that this, too, was quashed in the earlier proceedings. He further took the court through the single judge's observation that the CBFC chairperson's decision was without jurisdiction. When the CJ pointed out that the single judge was trying to maintain that what is not sought can also be granted by the court, the ASG cited a Supreme Court case wherein it said the court cannot grant reliefs that have not been prayed for. While concluding his arguments, the ASG reiterated that he and the CBFC were not given time to file a counter, and the January 6 communication was not challenged.

When the CJ asked if the advisory panel was not the same as the board, but constituted to assist the board, since it might not be possible to examine movies from all over the country, the ASG attested to the same. When the ASG stated that the communication letter was issued to the producers by the advisory panel, the CJ asked who had actually watched the movie and whether they were members of the board. The ASG maintained that they were members of the examining committee, who are part of the advisory panel, and stated that the movie was watched by the examining committee.
During the hearing, ASG Sundaresan pointed out that the examining committee's decision to issue 14 cuts after watching the movie was only an interim one and not a final decision. Now, he said, the movie's makers are demanding certification simply because they carried out the previously mandated 14 incisions, although the board had already issued an official communication stating that it had received a complaint. The board had also asked the regional office to put the proceedings on hold.
Pointing out that after the communication on December 22, there was a fresh communication from the CBFC's part on January 5, informing the makers that the earlier decision had been put on hold and that the board was sending the movie for review, ASG Sundaresan maintained that this was not challenged before the court.

"The film was submitted to the CBFC on December 18, 2025, and was viewed by the examining committee. On December 22, 2025, we received an email stating the film would be granted a U/A 16+ certificate, subject to a few changes. We incorporated the suggested changes and resubmitted the film," he reportedly said.
"A few days before our planned release, on January 5, 2026, we were informed that the film had been referred to the revising committee based on one complaint. With time running out to approach the revising committee and without knowing who the complainant was, we approached the honourable High Court," he added.
Venkat stated, "This has been an extremely emotional and difficult moment for everyone who has poured their heart, soul, and years of hard work into this film. Above all, we firmly believe that Thalapathy Vijay sir deserves the farewell he has earned through decades of love from his fans."
Reacting to the delay in Jana Nayagan receiving CBFC certification, director-screenwriter R Ajay Gnanamuthu, known for helming Demonte Colony movies, wrote on X (formerly Twitter) a few weeks back, "Absolute misuse of power. Any film is not just about one person; it has hundreds and hundreds of people's efforts, and money involved for a film to reach the screens. All strength to the team. Reacting to the Jana Nayagan controversy, actor Jason Shah, who plays a key role in the political action drama, told SCREEN: "I was really excited that the film was releasing on the 9th. I am not 100 per cent sure about the certification as to what goes on. I have never actually fully understood the process; it's not my department."
He added, "But religion and politics always have something to do with movies. Whoever is voted in as the ruling party they have been given the country in their hands to decide what happens. While the release of 'Thalapathy' Vijay's Jana Nayagan continues to hang in the balance, legendary cinematographer-director PC Sreeram has stepped forward to denounce the inordinate delay in the movie receiving certification. Taking to X (formerly Twitter), he wrote, "The might of the Indian state is fighting over one cinema. What a disgrace. #jananayagan."
In a separate post, he clarified that his remarks weren't only about the Vijay-starrer but rather a critique of the general "misuse of government agencies." The National Award-winning cinematographer noted, "My tweets about Jana Nayagan is not about one film, but the future misuse of government agencies in all aspects, which threatens democracy, be it state government or central government. This is the land of Mahatma Gandhi, not Donald Trump."
Although Jana Nayagan initially received relief from Justice PT Asha of the Madras High Court on January 9, when she directed the CBFC to immediately grant a U/A 16+ certificate to the movie, the makers' happiness was short-lived as a division bench, headed by High Court Chief Justice Manindra Mohan Shrivastava, stayed the single judge's order.
While the makers subsequently approached the Supreme Court against this order, it refused to entertain the plea and asked the Madras High Court to decide on the matter on January 20. Here's a timeline of all that's happened so far as the Madras HC is gearing up to hear the makers' plea again.

Although director H Vinoth's Jana Nayagan has been making headlines since day one, it hasn't been for the best of reasons for the past few weeks. Billed as 'Thalapathy' Vijay's final film before his full-fledged political entry, the political action drama has been mired in controversies since early this month after it failed to receive a green signal from the Central Board of Film Certification (CBFC) on time, affecting its previously announced release date of January 9.
Now, the Madras High Court is set to resume hearings in the Jana Nayagan case, and all eyes are back on the film to see if it will finally receive legal relief, paving the way for its much-anticipated release. As the Supreme Court has asked the High Court to decide the case on Tuesday, January 20, itself, the makers of the movie and fans of the star are hopeful that the tide will turn in their favour today.
