The Special TADA Court is likely to sentence actor Sanjay Dutt and his friends Yusuf Nullwala, Kersi Adajenia and Rusi Mulla on Tuesday — they are the only four remaining to be sentenced from among 100 convicted in the 1993 Mumbai serial blasts case.

All four have filed applications seeking release under the Probation of Offenders Act, which will be decided at the time of sentencing.

Special TADA Court Judge P D Kode has rejected similar applications filed by 70 others.

Dutt was convicted under the Arms Act on November 28 last year—three AK-56 rifles and a pistol were found in his possession in 1993. However, the court acquitted him of all charges under TADA, observing that, “he is not a terrorist”. Dutt, in his confession, had said he had procured these arms from absconding accused Anees Ibrahim for the protection of his family, which was under threat for helping riot-affected persons.

Nullwala, Adajenia and Mulla were convicted for being in possession of prohibited weapons, which belonged to Dutt, and trying to destroy them.

In his application seeking release under the Probation of Offenders Act, Dutt annexed four affidavits from eminent personalities, like actor Dilip Kumar, vouching for his good conduct. Justifying his crime as an act of self-defence, Dutt said that he is not a habitual offender and that he didn’t intend to harm anyone by procuring the weapons.

However, Special Public Prosecutor Ujwal Nikam opposed these applications, calling Dutt an “incorrigible offender”. Nikam also pointed out that Dutt had offered no explanation for the 25 hand-grenades found in his possession.

Judge Kode has asked the probation officers to submit a report about the conduct of Dutt and the three others.
