CHANDIGARH, Oct 16: The Punjab amp; Haryana High Court has stayed the repatriation of Rajwant Singh, an IPS officer, from the state of Punjab to his parent cadre of Andhra Pradesh. The petitioner, an IPS officer of the 1985 batch was posted as DIG Punjab Home Guards and Deputy Director Civil Defence, Punjab, Chandigarh.

A division bench of the court, comprising Justice J.L. Gupta and Justice N.C. Khichi, after hearing Rajwant Singh in person, also issued a notice to the respondents for December 17, while also staying his repatriation in the meantime.

The Central Government had placed his services on deputation with the Punjab Government in 1990 for two years. The deputation was regularly extended from 1992 till 1997, when the Central Government refused to grant sanction for further extension of his deputation.

The repatriation orders were earlier challenged by the petitioner before the local bench of the Central Administrative Tribunal, and he had prayed for granting permission for inter-cadre transfer on various grounds. The Tribunal had turned down the plea of the petitioner, holding that the Central Government was the best judge to decide whether an IPS officer could be kept on deputation in another state or not and vacated the stay orders granted earlier.

Aggrieved by the orders of the Tribunal, Rajwant Singh had approached the Punjab and Haryana High Court and presented his case in person.
