
CHANDIGARH, Oct 27: Taking up a criminal complaint filed by a cold storage firm against a transformer company, UT Judicial Magistrate Ist Class Jasbir Singh ordered the Station House Officer, Industrial Area, to investigate the matter and register a case.
The complainant, who is the managing director, Baba Ajit Singh Cold Storage, Jhungian village, Patiala, stated that his firm provides cold storage facilities to farmers for storage of agricultural products. Complainant Labh Singh stated that for this purpose, he purchased one high-power transformer from accused firm Unitech Transformers.
In October 1997, the said transformer became defective and so the complainant hired services of the accused firm.He handed over the piece to them for repair, but despite repeated visits, the accused firm failed to hand over the same to him. He was, instead, supplied with yet another transformer on condition and with a promise that the originally purchased one would soon be returned after repair.
The complainant added that he paid Rs 42,000 for the said repairs but the transformer has not been returned to him till date.He thus filed a criminal complaint in the court, requesting for enquiry into the matter and consequent registration of a case of fraud and criminal breach of trust under Sections 420 and 406 IPC, respectively.
