Congress party rubbished Samajwadi Party’s demand for a judicial probe into the Jamia Nagar encounter, saying it is inappropriate for a political party to take a stand on any police action.

“Our stand is clear on this. It is extremely inappropriate for a political party to take a stand on any police action, either in support or in opposition,” Congress spokesman Manish Tewari told PTI.

He said the law enforcement agencies are performing a tough task in the sense that they are fighting a un-uniformed enemy and if at all there are aberrations or excesses, which unfortunately is not uncommon in India, there are appropriate mechanisms in the Constitution for redressal.

“These mechanisms in the Constitution are specifically created to redress such aberrations and excesses,” Tewari said, referring to the judiciary and institutions like the NHRC.

“The aggrieved (including political parties) are well within their rights to access these institutions like the judiciary and the NHRC,” said the spokesman, adding, “their objectivity and fairness for justice have been demonstrated”.

With the encounter acquiring political overtones, party General Secretary Digvijay Singh last week said the queries regarding the encounter must be answered.

While visiting the Batla House area on Saturday where the encounter took place last month, SP leader Amar Singh demanded a judicial probe and suggested Patil to step down on moral grounds till Delhi Police gets a clean chit in the investigation.
