CHANDIGARH, June 15: Arguments on the defence counsel8217;s application for changing the Central Bureau of Investigation8217;s special prosecutor continued in the former chief minister of Punjab Beant Singh8217;s assassination case, here today.

The application, submitted before the then UT District and Sessions Judge, Amar Dutt, had sought directions forbidding special prosecutor S. K. Saxena from conducting the prosecution case.

They had alleged that Shamsher Singh8217;s alleged confessional statement was prepared by him and his presence was quot;causing prejudice to the accusedquot;.The application had been moved almost two-and-a-half years after the recording of evidence began in the case .

Meanwhile, arguing before UT District and Sessions Judge B. S. Bedi in the makeshift courtroom at Model Jail, Burail, CBI counsel R. K. Handa denied the defence counsel8217;s allegations regarding accused Shamsher Singh being interrogated in the presence of special prosecutor along with three other officials.

He stated that Y. K. Saxena and not S. K. Saxena was present in the court of Metropolitan Magistrate V. K. Maheshwari when Shamsher Singh8217;s alleged confession was recorded on December 16, 1995. Moreover, DSP Surinder Pal was also not involved in the investigation of the case, he said.

Handa further stated that the special prosecutor could not be asked to withdraw from the case. The defence counsel was not cooperating with either the court or the prosecution, he further charged. The case will now come up for arguments on July 28.
