PATNA, June 24: The Central Bureau of Investigation faced a piquant situation today as the special court declined to pass arrest warrants against the accused in the fodder scam. But the Patna High Court, which is monitoring the case pulled up the investigative agency for not arresting some of the accused including politicians.However, CBI Joint Director (east) U N Biswas, assured the High Court that there was no external pressure on him in the matter of arrest. He said those chargesheeted in RC 20(A)/96 (filed yesterday) of the fodder scam would be arrested shortly.The CBI was put in a spot, when the special court turned down its request for issuance of arrest warrants against the Bihar Chief Minister and others by declining to take instant cognizance of the chargesheet filed yesterday.The special court declined to take cognizance of the chargesheet against Laloo Prasad Yadav and 55 others for want of certain documents or extracts thereof which the agency then promised to make available at the earliest.Even the high court hearing was no relief for the agency. But its hands were somewhat strengthened by the remark of the judges who asked the CBI not to discriminate in making arrests. The Division Bench of the high court, comprising Justice S N Jha and Justice S J Mukhopadhyay asked the CBI not to use different yardsticks for politicians and other accused.On a submission by CBI counsel, Rakesh Kumar, that some of the accused, including politicians, had not been arrested because of fear of law and order problems, Justice Mukhopadhyay asked, ``Can you cite one case in the country in which legal action has not been taken for fear of breach of peace?''``If you fear breakdown of law and order you should write to the Government of India maintaining law and order,'' he said.
