
CHANDIGARH, July 1: The Chandigarh Administration, in a letter to Mayor Kewal Krishan Adiwal, has advised him not to interfere in the functioning of Municipal Commissioner S.K. Gathwal while performing his statutory duty.
Quoting Section 52 of the Punjab Municipal Act, 1954, the Administration has reminded the Mayor that all executive powers of the Corporation rest with the Commissioner who is competent to implement decisions in the interest of Corporation until he relinquishes the charge of the post.
Earlier, the Mayor had sent a note to the Municipal Commissioner asking him to take no important decision in view of his transfer order. Subsequently, the Commissioner is reported have referred the Mayor8217;s letter to the UT Administrator seeking his advice.
BJP-SAD councillors have welcomed the Administration8217;s letter, saying the letter quot;has put the Mayor in his placequot; and termed it a victory of the commissioner with whom the mayor and ruling party members have been in conflict for long.
It may be recalled that BJP-SAD councillors had raised a short notice query saying the Mayor had disgraced the Corporation by interfering in the functioning of the Commisioner and issued an unlawful8217; order to the commissioner not to perform his duty. Referring to the Mayor8217;s letter to the commissioner in which he advised him to stop anti-encroachment operations, the Mayor8217;s opponents charged that the latter was motivated by political considerations.
The matter is likely to be raised tomorrow in the meeting of the 29-member House of the Corporation.
