
CHANDIGARH, April 20: A Punjab Police constable, charged with submitting forged matriculation certificate and marks-sheet for recruitment, has been sentenced to three years rigorous imprisonment and fined Rs 700 by UT Judicial Magistrate Ist Class Sanjiv Kumar.
Jaswant Singh was booked by the Chandigarh Police in November, 1985, for cheating, forgery and using a forged document as genuine on the complaint of Director, Police Telecommunication, Punjab, Charan Pal Singh.
Arguing before the court, public prosecutor Rajinder Singh said the forgery was detected after Secretary, Punjab School Education Board, declared the matriculation certificates and detailed marks card to be bogus. The same, submitted by the accused after having been selected, had been sent to the PSEB for verification.
When confronted with the incriminating evidence, the accused contended that he was being falsely implicated . He said that he had neither applied for the post, nor had submitted the forged certificate.The accused also stated that he was working as a domestic help in Jalandhar when the recruitment took place. He said the form had not been filled up and signed by him.
Moreover, he had never visited the City prior to his appearance before the court. The defence counsel added that the action could not be taken against the accused as he had been dismissed from service and punishing him again would violate Article 20 2 of the Constitution.
