Holding the state government,the Deen Dayal Upadhaya University,Gorakhpur,and two colleges responsible for ruining the career of around 200 students,the Allahabad High Court has awarded a compensation of Rs 1 lakh to each of those students.
The students were enrolled in BEd programmes run by the Dulari Devi Degree College,Deoria and Lal Bahadur Shastri Smarak PG College,Maharajganj,which lacked recognition by the National Council for Teacher Education (NCTE). The colleges,along with the DDU University and the state government,are to bear the costs of compensation.
In response to a number of writ petitions filed by students,Justice VK Shukla ordered that of the Rs 1 lakh compensation,Rs 50,000 will be paid by the management of the institution the student was enrolled in.
The remaining Rs 50,000 will be paid by the state government and the DDU University.
According to the order,all compensations are to be paid within two months,said R N Singh,counsel for the petitioners.
The court observed that the petitioners were not at fault,as it has been found that the two institutions were unrecognised for the 2008-2009 academic session.
The court,therefore,directed the management of both institutions to return the entire fee to the petitioners with nine per cent simple interest.
The state government was also told to to arrange for the admission of these students for 2010-2011 academic session in any college affiliated with the DDU University. The admission process should also be completed within two months and is to be made on basis of the students merit status in the earlier examination.
For this purpose,the court has directed the government to call for the list of NCTE-affiliated private colleges which run a BEd course,Singh said.
The candidates,according to the court,should be distributed in equal proportion in those colleges as per their merit status and choice.
