Akash Banerjee, nephew of Chief Minister Mamata Banerjee, and three of his associates who spent a day in judicial custody for assaulting a traffic sergeant were today given bail by a court here.

Chief Judicial Magistrate,Alipore,Shahnawaz Hossain allowed the bail plea of Banerjee,Nitish Singh,Md Sarmuddin and Amit Mishra till August 16 on a bail bond of Rs 1,000 each.

The court on Wednesday rejected the bail of Akash on the ground that the police had applied section 353 of the IPC (assault or criminal force to deter public servant from discharge of his duty) — a non-bailable offence — in the case.

Moving the bail plea,Shantanu Dutta, counsel of Akash, pleaded that the non-bailable charge was wrongfully applied in the case,as the latter had only demanded the seizure list from the police when his car was detained for violation of the traffic rules at Watgung.

Akash never assaulted the police inspector and that there was no progress in investigation during the last 24 hours,Dutta added.

The counsel further said Akash and his aides have already passed two days in custody and assured the court that they would comply with the conditions imposed by the court.
