Cop records statement in 2002 rape case

In yet another blow to the prosecution in the controversial rape on wheels case,a Chandigarh Police constable recorded his statement in the court on Thursday,stating that the 20-year-old victim was recovered in an unconscious state and the visiting card of a company owned by industrialist

M K Jain was recovered from her. Constable Avtar Singh recorded his statement before Additional District and Sessions Judge V P Sirohi.

In 2002,Singh was the first to reach Sector 33,after receiving information that a girl was found unconscious. Singh said Surinder Sharma and Baldev Kumar were also present at the spot when he reached there.

The Chandigarh Police had registered a case in August 2002 against former UT home secretary N K Jain and four others for hatching a conspiracy to frame Jain in the rape case. The Shimla-based girl had alleged that Jain had picked her up from a Sector 20-based computer centre,saying he would give her a job. On their way to Panchkula,she alleged,Jain gave her a cold drink laced with drugs and later raped her,before dumping her near the Sector-33 petrol pump.

However,after investigations conducted by the UT police,it came to light that the victim had not been raped by Jain,but by the former UT home secretary,who hatched a conspiracy to falsely implicate the businessman. On August 7,2010,the court framed charges against N K Jain,Ram Lal,Surinder Sharma,Baldev Kumar and Narvir Singh.

Forged certificate case: HC issues notice to cop,UT

The Punjab and Haryana High Court issued notices to Inspector Ram Gopal and the Chandigarh Administration on Thursday on a joint petition filed by inspectors of the Chandigarh Police. The petitioners have challenged the acceptance of a cancellation report of a forgery and cheating case registered against Ram Gopal by a trial court last year.

Arguing on behalf of the petitioners,senior advocate Bipan Ghai contended that the only question involved in the investigation was “whether Yoga certificate from Italy submitted by the accused was forged,fabricated or genuine”. Ghai said the earlier inquiry was conducted by a deputy superintendent of police,CID,Chandigarh,who had reported that the certificate submitted by Inspector Ram Gopal was fake and forged one. “Since the alleged Yoga certificate was said to be issued from Italy,hence,proper course would have been to send a letter of request to the authorities concerned which was not done. Hence,request was made before the magistrate for further investigation,” Ghai averred.

He added that in a subsequent report submitted by a senior police officer,Ram Gopal was given a clean chit and he even got promotion later.

“Neither the investigating officer nor the magistrate should have closed the case in haste and rather a letter of request ought to have been issued to the authority in Italy to confirm the authenticity…” reads the petition.
