The Bombay High Court Monday asked the state government to at least indicate when it will table the report of the inquiry commission appointed to probe the Adarsh Cooperative Housing Society scam in the legislature.
The state government told the court Monday that the petition seeking directions to the government to table the report in both Houses of the legislature was not maintainable. The court,however,overruled the argument.
The court was hearing arguments of assistant government pleader G W Mattos,who said the petition filed by two BJP leaders Yogesh Sagar and Atul Shah was not maintainable. Relying on an Andhra Pradesh High Court order and citing the provisions of the Commission of Inquiries Act,Mattos said it wasnt mandatory for the state to table the report in the Assembly.
The provision doesnt show that it petition is not maintainable. Show us the judgment which shows that the writ is not maintainable, said the division Bench of Justice V M Kanade and Justice M S Sonak.
After listening to the arguments,Mattos sought time and gave an undertaking that the state will inform the court when it would table the inquiry commission report on Tuesday.
