Road death: Labourer gets Rs 11 lakh

MACT ordered a compensation of Rs 11.08 lakh to the parents of a youth,who was killed in a road accident here in 2008.

The Motor Accident Claims Tribunal MACT has ordered a compensation of Rs 11.08 lakh to the parents of a youth,who was killed in a road accident here in 2008.

The actual amount ordered to be given by the Tribunal was Rs 9.16,which was Rs 1.16 lakh more that what the parents had claimed.

Besides this,judge at the tribunal S Y Kulkarni also directed seven per cent interest,which comes to Rs 1.92 lakh,be paid to the parents from the date of filing of the claim three years ago.

The case relates to one Manjo Nathu Choudhary 27,who worked as an operations executive with M/s Unifreight India Ltd. On November 15,2008,when he was proceeding towards Panvel on his motor bike,a tanker dashed him from behind,killing him on the spot.

Following the incident,his 60-year-old father Natu Harlal Chaudhary and mother Purwanta,who are from Balaght district of Madhya Pradesh,approached the tribunal alleging that the accident had taken place due to the tanker driver8217;s negligence.

They claimed Rs 8 lakh compensation. Tanker owner Jagdhari B Yadav,ICICI Lombard General Insurance Company are opponents in the case and while ICICI was represented by Ms R S Kenjalkar,Yadav did not not appear in the court and the matter was decided ex-parte against him.

The insurance company,with which the tanker was insured,said the compensation being claimed was 8220;highly exorbitant8221;.

However,observing that the accident had occurred due to tanker driver8217;s rash and negligent driving,the court said that considering the total loss of dependency,the applicants will get a sum of Rs 1.16 lakh more than the claim amount

The court further said in addition to this,interest for the three year period,which comes to Rs 1.92 lakh,will also be added.

The judge also directed that 50 per cent of the compensation amount has to be kept in the fixed deposit for a period of three years,which should be renewed each time.
