The ruling coalition government has given up on the possibility of promulgating a new Constitution by the May 28 deadline. Prime Minister Madhav Nepal informed leaders of seven smaller political parties on Thursday that there was no hope that a new Constitution would be delivered by the deadline .
The governemnt is not averse to extending the life of the Constituent Assembly for a year or so if political parties arrive at a consensus, Nepal told heads of several parties,some of whom doubted the governments ability to deliver the Constitution even with an extended tenure.
The interim Constitution has no provision of extending the tenure of the Constituent Assembly which has been given a rigid deadline to deliver the Constitution. Why should the incompetent Constituent Assembly and political parties be rewarded for their failure? asks Dr Bhimarjun Acharya,a noted Constitution lawyer. He said the House stands automatically dissolved and the country must remain prepared for the next option.
Even if the government decides to go forward with a Constitutional amendment plan to extend the tenure of the House,the Bill will require two-third majority endorsing it,and that is not possible without the support of the Unified Communist Party of Nepal-Maoists UCPN-M. The Maoists
have made it clear to the government that they would support such a Bill only if Prime Minister Nepal quits,and hands over the top post to Maoist Chief Prachanda.
The Prime Minister will consult leaders of the bigger parties including the Nepali Congres and the Maoists soon, said Bishnu Rijal,Press advisor to the Prime Minister.
