In a relief for Aiad Amar Saad Mohammad,a Libyan national,the Supreme Court on Wednesday allowed him to stay in the country after the Home Ministry asked him to visit Libya,for seeking an extension of his visa. The Bench of Justices Markandey Katju and Gyan Sudha Mishra,hearing Shinoj Narain,Mohammads counsel,issued an order,staying the deportation on humanitarian ground and issued notice to the Union government to respond within four weeks.
Without waiting for the registry,where his petition was pending,the advocate urged to the court that the Ranchi University scholars visa was going to lapse on March 17 and the authorities were not willing to extend it despite the ongoing turmoil in Libya. He argued that the Union government had sufficient power to extend his visa and the refusal to do so would amount to violation of the petitioners Fundamental Right to Life under Article 21 of the Constitution,which is available to foreign nationals also.
