The Union Cabinet will on Friday consider increasing retirement age of High Court judges from 62 to 65,a step that will,if approved,bring them on par with Supreme Court judges who retire at 65.

The proposal had been mooted by the previous UPA government and then recommended by the standing committee of law and justice,which had argued that the step would help in clearing the huge backlog of cases in the High Courts.

According to the Cabinet note moved by the Law Ministry,it will also help in filling vacancies for High Court judges. Currently,there is a vacancy of 270 judges in HCs. The move will also ensure that deserving but superseded Chief Justices of High Courts,will be able to serve for three more years in the HCs in the event that they are not elevated to the Supreme Court.

Increasing the retirement age of High Court judges,however,will require a constitutional amendment with two thirds majority in both houses of Parliament. The government,already under pressure from the Opposition on the price rise issue,will have to seek support of BJP if it wants to go ahead with the move.

Arun Jaitley,Opposition leader in the Rajya Sabha,supports the move but wants a caveat in the form of a clause that the judges should not be given post-retirement assignments in tribunals and other similar posts.
