I had booked an apartment in Ghaziabad in Feb 2009. The builder promised to give the possession of the flat in Jan 2010,but I got the possession of my flat in March 2011. During this period I had to pay rent of Rs 13,000 per month. Can I claim this amount from the builder ?
Ritesh Sinha,Ghaziabad
Please check your agreement as to what the builder has agreed to pay in case of delay in possession. If you can establish that the builder was aware that you would have to pay rent if possession is delayed, your case gets better. If your contract specifies damages that can be claimed for delayed possession, you can claim what is specified. Send a notice to the builder with your demand and if he does not agree, approach the consumer forum.
I am planning to buy some agricultural land near Pune and the seller is an tribal. Is there any restriction on buying such land ?
Sandeep Patil,Nasik.
Sale of land by an tribal requires prior permission from the collector. If you buy the land without permission, such a sale can be rescinded anytime upto 30 years. Please exercise extreme caution in such deals.
I have bought a plot in Sector 133,Noida and paid the booking amount. I have paid nearly 60 per cent of the amount to the developer but the only documents I have are a provisional allotment letter and a receipt for the plot booked. What documents should I ask the developer to provide ?
Gunit Singh,Noida
Please ask the builder to immediately execute and register the sale deed with you. This is critical as your rights and the builders obligations will be clear in the agreement. Till then, you run the risk of the builder changing terms arbitrarily, demanding more money under various pretexts, etc.
