JULY 16: Monopolies and Restrictive Trade Practices Commission MRTPC has exonerated Tata Engineering amp; Locomotive TELCO from charges of unfair trade practices but hauled up one of its authorised dealers for misleading a customer.

Director general of investigation and registration had charged TELCO and Cargo for indulging in unfair trade practices on the basis of a complaint that the dealer sold incomplete chassis of its diesel vehicle.

A two-member bench of the commission discharged a notice of enquiry issued against TELCO while asking the dealer Cargo Motors Ltd to cease and desist from practising the alleged unfair trade.

The complainant had claimed that the dealer had supplied a chassis of four wheel rims and four tyres due to shortage in accessories though it had charged for a model with seven wheel rims and six tyres.

quot;The delay caused in delivery of the short supply items certainly caused loss to the customer,quot; the order said adding that false representation in regard to supply of wheel rims and tyre was made through proforma invoice.

The bench said the dealer was very well aware of the fact that due to short supply of parts, it could not supply the accessories as indicated in the proforma invoice.

Discharging the notice against TELCO, the bench said it could be not established that the company indulged in unfair trade practices as charged by the complainant.
