
Insurance claim can8217;t be beyond policy terms: SC New
Delhi: The Supreme Court has ruled that insurance claim under any policy has to be strictly within the terms and conditions expressly specified in it and cannot go beyond those in any circumstances.
8220;The insured cannot claim anything more than what is covered by the insurance policy. That being so, the insured has also to act strictly in accordance with the statutory limitations or terms of the policy expressly set out therein,8221; Justice S Saghir Ahmad said in a recent judgement.
The judgement came on an appeal by Oriental Insurance Company which had challenged the order of National Consumer Dispute Redressal Commission NCDRC granting insurance of Rs 1.93 lakh to a transporter whose truck caught fire near Hubli district in Karnataka in 1994 while carrying ethyl ether8217;, a hazardous substance, ferrying of which was not covered under the insurance policy.
Extra-judicial confession is a weak evidence, rules Apex Court
NEW DELHI: TheSupreme Court has ruled that extra-judicial confession about committing a crime by an accused is a very weak8217; evidence and he cannot be convicted merely on the basis of it without independent corroboration.
Accepting an appeal by a convict from Barnala district in Punjab, sentenced to life imprisonment along with his mother for murdering his wife, a division bench comprising Justice G T Nanavati and Justice S N Phukan said the Punjab and Haryana High Court and the trial court had 8220;committed grave error in relying upon extra-judicial confession as it is highly improbable.8221;
Bihar flood situation worsens
PATNA: The overall flood situation in Bihar worsened today with swirling waters inundating over 300 villages spread over Gopalgunj, Sitamarhi, West Champaran, Darbhanga and Katihar. Official sources said gushing waters of Gandak inundated over 80 villages. Flood waters have also submerged several villages in Darbhanga, Sitamarhi and Gopalgunj. At least 238 people have lost their lives so far inthe current spell of floods that damaged standing crops and other property worth over Rs 50 crore.
Court restrains telecast of serial
NEW DELHI: A Delhi court today restrained Prasar Bharati and producer-director Suhaib Ilyasi from commencing telecast of the serial, 8220;Fugitive, The Most Wanted8221; on Doordarshan. Civil judge Sanatan Prasad issued the stay order on a complaint by Vinod Nayyar who has claimed that the concept and the rights of the programme lie with her. The judge fixed August 27 as the next date by which Prasar Bharati and Ilyasi should file their reply.
Deshabhimani manager attacked
KANNUR: The Manager of Deshabhimani, a Malayalam newspaper, P Jayarajan, and another person Saji were injured in a bomb attack at Kes Kathirur under Panoor police station last evening. A group of armed persons, alleged to be BJP and RSS activists, pounced on Jayarajan at his residence last evening and destroyed his house, police said, adding that a hunt was on to trace the culprits. Thecause for the attack was not immediately known.
